coming up. a rural community is stunned after they arrested the brother in the death of leila fowler, she was found stabbed to death in valley springs late last months. her brother first told them he saw a male intruder running through the scene. and examining dna evidence and interviewing the family, detectives arrested his 12-year-old brother last night. >> during the past 15 days. we have conducted extensive investigation. these types of cases require several at a time. and it was our commitment to make sure we did a thorough job as possible. >> despite the arrest, the sheriff said it is still an active investigation. the district attorney will decide whether to prosecute the 12-year-old as an adult. deputies are still guarding the fowler home and the family has

here are the events. leila fowler was stabbed to death. the 12-year-old brother said he saw a tall man with long gray hair running away. >> on may second, they were analyzing several knives at the home to see if one was the weapon use the attack and last night. they announced they arrested his 12-year-old -- her 12-year-old brother. we posted the entire news conference on line. click on the bay area news tab. there is a disputed piece of farm land owned by uc berkeley. we are live now in albany with more on the resistance the protestors face as they try to reclaim the plot of land. katie? >> reporter: they camped out overnight. we have a few people waking up.

yesterday, they planted rows of squash. and other vegetables here in this piece of land. they are trespassing and they say it is worth it to stop very many. if we move over to the left. they have a whole bunch more plants to plant today. they are hoping that uc berkeley will realize what a reasonable resource this is as a farm as opposed to a development. >> this is peaceful and they showed up here and show you the resistance movement that started yesterday. >> our press passing and in -- trespassing and in violation of the penal code. >> reporter: farmers took over this tract. it is owned by the university of california berkeley and slated for development. more than 50 people entered the property at san pablo avenue.
